Agreement to Terms

These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with BuddySplit mobile application (the "Service") operated by MalihSolutions ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our Service. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Definitions

For the purposes of these Terms:

• Account means a unique account created for you to access our Service.
• Application refers to BuddySplit, the mobile software program provided by MalihSolutions.
• Company (referred to as "the Company", "we", "us" or "our") refers to MalihSolutions.
• Content refers to content such as text, images, expense data, or other information that can be posted, uploaded, linked to or otherwise made available.
• Device means any device that can access the Service such as a smartphone or tablet.
• Service refers to the BuddySplit Application.
• You refers to the individual accessing or using the Service.

Acceptance of Terms

By downloading, installing, or using BuddySplit, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Use of the Service

Permitted Use

You may use BuddySplit for:

• Creating and managing shared expenses with friends and groups
• Tracking balances and payments within your groups
• Inviting others to join your expense groups
• Viewing and managing your expense history

Prohibited Use

You agree not to use the Service:

• For any unlawful purpose or to solicit others to unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service

User Accounts

Account Creation

To use certain features of BuddySplit, you must create an account. You may create an account using:

• Email and password
• Apple Sign-In
• Google Sign-In

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring the accuracy of information provided during registration

Content and Data

Your Content

You retain ownership of all content you create or upload to BuddySplit, including:

• Expense descriptions and amounts
• Group names and information
• Comments and notes
• Profile information

Content Accuracy

You are solely responsible for the accuracy of all expense data, payment records, and other information you enter into BuddySplit. We are not responsible for any disputes arising from inaccurate or incomplete information.

Content Sharing

By using BuddySplit, you understand that:

• Expense information is shared with relevant group members
• Your profile information is visible to other users in your groups
• Payment and balance information is shared as necessary for expense tracking

Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

Limitation of Liability

In no event shall MalihSolutions, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or data
• Loss of use or business interruption
• Cost of substitute goods or services
• Any damages arising from disputes between users

Indemnification

You agree to defend, indemnify, and hold harmless MalihSolutions from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any claim that your content caused damage to a third party

Service Availability

We strive to maintain the Service, but we cannot guarantee:

• Continuous, uninterrupted access to the Service
• That the Service will be error-free or bug-free
• That all features will be available at all times
• That data loss will never occur

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MalihSolutions. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

Third-Party Services

BuddySplit may contain links to third-party websites or integrate with third-party services. We are not responsible for:

• The content or privacy practices of third-party services
• Any damages or losses caused by third-party services
• The availability or functionality of third-party services

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and MalihSolutions regarding the Service and supersede all prior understandings, agreements, representations, and warranties.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. Material changes may be communicated through:

• In-app notifications
• Email notifications (if provided)
• Updates to this page

Your continued use of the Service after any changes constitute acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

No waiver by MalihSolutions of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
